Please read before proceeding. By accessing this website or engaging Candor Groups for any real estate service, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, please discontinue use of our platform immediately.

Section 01

Acceptance of Terms

These Terms of Service ("Terms") constitute a binding agreement between you ("Client," "User," or "you") and Candor Groups (formerly Candor Properties), a real estate consultancy registered under MahaRERA bearing registration number A52100007122, with its principal office in Kharadi, Pune, Maharashtra, India ("Candor Groups," "we," "us," or "our").

By visiting our website, submitting an enquiry form, calling our offices, attending a site visit arranged by us, or entering into any service engagement, you agree to these Terms in full. These Terms apply to all visitors, clients, and any other persons who interact with Candor Groups in any capacity.

If you are accessing our services on behalf of a company or organisation, you represent and warrant that you have the authority to bind that entity to these Terms.

Section 02

Our Services

Candor Groups is a licensed real estate agency offering the following services:

  • Real estate consultancy and brokerage for residential, commercial, industrial, and agricultural properties.
  • Property search assistance, site visit coordination, and negotiation support on behalf of buyers, sellers, and tenants.
  • Legal advisory and title verification in coordination with empanelled advocates.
  • Home loan facilitation in partnership with empanelled banks and NBFCs.
  • Property management services for landlords and investors.
  • Vastu consulting, interior design referrals, and architectural guidance.
  • Investment advisory for real estate portfolio planning.

All services are provided subject to the specific scope agreed in writing or verbally between Candor Groups and the client at the commencement of the engagement. We act as an intermediary and facilitator; we are not a party to any property sale, purchase, or lease agreement unless expressly stated.

Regulatory note: Candor Groups operates in compliance with the Real Estate (Regulation and Development) Act, 2016 (RERA), the Transfer of Property Act, 1882, and all applicable Maharashtra state laws governing real estate transactions.

Section 03

Client Obligations

As a client engaging Candor Groups, you agree to:

  • Provide accurate information: All personal details, financial information, property specifications, and documentation you share with us must be true, current, and complete. Providing false or misleading information may result in termination of our engagement without liability to Candor Groups.
  • Honour exclusivity where agreed: Where you have entered into an exclusive engagement letter with Candor Groups, you agree not to engage a competing broker for the same transaction without our written consent during the exclusivity period.
  • Attend scheduled visits: Provide reasonable advance notice (minimum 4 hours) if you are unable to attend a site visit that has been scheduled on your behalf. Repeated cancellations without notice may result in discontinuation of services.
  • Maintain confidentiality: Property pricing, negotiation details, and transaction structures shared by Candor Groups are confidential and should not be disclosed to third parties not involved in the transaction.
  • Act in good faith: You agree to engage with builders, sellers, landlords, and other parties introduced by us in good faith, and not to circumvent Candor Groups by dealing directly with a party introduced through our services during or within 12 months after the engagement to avoid our fees.
Section 04

Brokerage & Fees

Candor Groups earns a professional service fee (brokerage) upon the successful completion of a transaction facilitated by us. The applicable fee structure is as follows, unless a different arrangement is agreed in writing:

  • Purchase transactions: Brokerage is typically payable by the buyer and/or builder as per market practice and the specific arrangement disclosed at the time of engagement.
  • Rental transactions: One month's rent (or as agreed), payable upon execution of the lease agreement.
  • Commercial transactions: Fee as mutually agreed and confirmed in the service mandate.

Our brokerage fee becomes due and payable upon execution of the agreement to sell, sale deed, lease deed, or equivalent legally binding document between the parties introduced by Candor Groups. Fees are non-refundable once the transaction has been concluded.

Transparency commitment: Candor Groups will disclose the applicable fee structure to you clearly before proceeding with any engagement. There are no hidden charges. Any additional costs (registration fees, stamp duty, advocate charges) are statutory or third-party costs and are not retained by Candor Groups.

Section 05

Property Information

All property listings, project details, floor plans, price indications, and availability information displayed on our website or communicated verbally are provided in good faith based on information supplied by builders, sellers, and developers.

  • Prices and availability are subject to change without notice and should be independently verified at the time of booking.
  • Floor plans, renders, and project images may be artist's impressions and may not exactly represent the final product.
  • RERA registrations, approvals, and project statuses are as communicated by the respective developer and should be verified on the MahaRERA website (maharera.mahaonline.gov.in).
  • Candor Groups does not guarantee or warrant the accuracy, completeness, or fitness for purpose of any property information provided.

Clients are encouraged to conduct their own due diligence, including independent legal and technical inspections, before committing to any transaction.

Section 06

No Guarantee of Transaction

Candor Groups acts as a facilitator and intermediary. We do not guarantee that:

  • A suitable property will be found within a specified timeframe.
  • A seller, builder, or landlord will accept any particular offer made on your behalf.
  • A transaction once initiated will be successfully completed, as this depends on multiple parties beyond our control.
  • Investment returns, rental yields, or capital appreciation projections shared during advisory discussions will be achieved.

Any investment projections or market analyses we share are based on publicly available data and our professional judgment at a point in time. Real estate markets are subject to market risk, regulatory changes, and macroeconomic factors. Past performance and market trends are not a guarantee of future results.

Section 07

Limitation of Liability

To the maximum extent permitted by applicable law, Candor Groups' liability to you in connection with any service or transaction shall be limited to the brokerage fee paid by you to Candor Groups for that specific transaction.

We shall not be liable for:

  • Any loss of profit, revenue, or investment return arising from a property transaction, even if we were advised of the possibility of such loss.
  • Loss or damage resulting from the acts or omissions of third parties, including builders, sellers, advocates, financial institutions, or government authorities.
  • Delays in government registrations, approvals, or processes outside our control.
  • Technical errors, downtime, or data loss on our website.
  • Any claim arising from inaccurate information provided by you or a third party.

Nothing in these Terms limits our liability for fraud, death, or personal injury caused by our negligence.

Section 08

Intellectual Property

All content on the Candor Groups website — including text, photographs, graphics, logos, videos, and the overall design — is the intellectual property of Candor Groups or is used under licence, and is protected under the Copyright Act, 1957 and other applicable laws.

  • You may view, print, and share our content for personal, non-commercial purposes.
  • You may not reproduce, republish, distribute, sell, or create derivative works from our content without prior written permission.
  • The "Candor Groups" name and logo are proprietary marks. Any use without authorisation is strictly prohibited.

Property photos uploaded to our platform by third-party developers remain the property of their respective owners. Any misuse of such material is the responsibility of the person misusing it.

Section 09

Termination

Either party may terminate an engagement with Candor Groups at any time by providing written notice (via email or letter), subject to the following:

  • If Candor Groups has already introduced you to a property and a transaction is in progress or completed, our fee remains payable.
  • Candor Groups reserves the right to discontinue services immediately and without notice if a client is found to be acting in bad faith, providing fraudulent documentation, or engaging in circumvention as described in Section 3.
  • Upon termination, both parties' obligations regarding confidentiality and non-circumvention survive for 12 months.
Section 10

Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, with specific applicability of Maharashtra state laws where relevant to real estate matters.

In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation within 30 days of the dispute arising. If negotiation is unsuccessful:

  • Disputes relating to RERA-regulated transactions may be referred to the Maharashtra Real Estate Regulatory Authority (MahaRERA).
  • All other disputes shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.
Section 11

Amendments

Candor Groups reserves the right to update or amend these Terms at any time. Changes will take effect from the date they are published on this page, indicated by the revised effective date at the top of this document.

It is your responsibility to review these Terms periodically. Continued engagement with our services following any amendments constitutes acceptance of the revised Terms.

For material changes, we will make reasonable efforts to notify active clients via the contact details on file.
